Acceptance
By accessing or using EasySwatch you agree to these Terms.
License
A Pro purchase grants one individual user a personal, non-transferable license. The licensed user may use Pro on any devices they personally own or control through Dropbox synchronization. A Pro license may not be shared with other people.
One-Time Purchase
Pro is sold as a one-time purchase.
Thirty-Day Money-Back Guarantee
Any Pro purchase is eligible for a no-questions-asked refund if requested within 30 days of the purchase date.
Duration of License
Your Pro license remains valid for as long as EasySwatch continues to offer the product and associated licensing services. EasySwatch may discontinue the product or service at any time. If the product is discontinued, licenses terminate and no refunds will be issued beyond the 30-day guarantee.
User Data
You retain ownership of your own palettes and user-created content. EasySwatch does not store your palettes. You are responsible for maintaining backups. EasySwatch is not responsible for loss of data stored in Dropbox or elsewhere.
Printed Output and Color Accuracy
EasySwatch is a creative planning tool. Colors displayed on screens, printed templates, and generated palette information may vary due to differences in monitors, printers, paper, paints, lighting, and manufacturing variations. You are responsible for reviewing and verifying all palette information and printed output before relying upon it.
Intellectual Property
The EasySwatch software, trademarks, website, documentation, and original content are protected by applicable intellectual property laws. Manufacturer paint names, swatches, trademarks, and vendor-supplied information remain the property of their respective owners.
Third-Party Services
EasySwatch relies on third-party services including Dropbox and Stripe. Their availability, security, and policies are outside our control.
Disclaimer of Warranties
EasySwatch is provided "AS IS" and "AS AVAILABLE" without warranties of any kind.
Limitation of Liability
To the maximum extent permitted by law, EasySwatch's total liability shall not exceed the amount paid by the user for the applicable Pro purchase. In no event shall EasySwatch be liable for indirect, incidental, consequential, or special damages.
Governing Law
These Terms are governed by the laws of the State of Oregon.
Changes
We may revise these Terms from time to time by publishing an updated version on the EasySwatch website.
